Refund & Cancellation Policy

This policy applies to all retainer, project, and sprint engagements delivered by THEPROJECTSEO DIGITAL (OPC) PRIVATE LIMITED, trading as Grow With Gradient.

1. Scope

This policy governs all fee arrangements between clients and THEPROJECTSEO DIGITAL (OPC) PRIVATE LIMITED (CIN: U73100JH2025OPC026020), operating as Grow With Gradient. It covers:

  • Monthly retainer engagements (Startup, Scaleup, and Enterprise tiers)
  • Fixed-scope project and sprint engagements
  • The free paid-to-organic gap analysis and any associated onboarding fee

Where a signed Statement of Work (SOW) or Master Service Agreement (MSA) contains specific refund or cancellation terms, those terms govern. This policy fills any gaps not addressed in the SOW/MSA.

2. Monthly Retainer Engagements

Billing Cycle

Retainers are billed monthly in advance on the date agreed in the SOW. Each billing cycle covers a discrete calendar month of service. Fees are exclusive of applicable goods and services tax (GST) at the prevailing rate.

Cancellation Notice

Either party may cancel a retainer by providing 30 days written notice to the other party. Notice must be sent to the account contact email on file. The retainer continues in full force during the notice period; no discount or pro-ration applies to the final month unless agreed in writing.

Refund Eligibility on Retainers

  • Fees already paid for a completed month are non-refundable. SEO and content services are delivered on an ongoing basis and the value is consumed progressively throughout the month.
  • Fees paid in advance for future months beyond the current billing cycle are refundable in full if cancellation notice is given before the next billing date, and no work has commenced on those future months.
  • Partial-month refunds are granted only if Grow With Gradient terminates the engagement without cause during an active billing cycle. In that case, a pro-rated refund is calculated on a per-calendar-day basis.

3. Fixed-Scope Projects and Sprints

Milestone Billing

Project and sprint engagements are typically billed across defined milestones set out in the SOW (for example, 50% on kickoff, 50% on delivery). Each milestone payment corresponds to a deliverable or phase of work.

Cancellation Before Commencement

If a client cancels a fixed-scope project before any work has commenced and before the kickoff payment is processed, no fee is due. A deposit or kickoff payment already processed is non-refundable because it covers setup, initial research, and resource reservation costs.

Cancellation After Commencement

If a client cancels after work has commenced, the following applies:

  • Completed milestones billed prior to cancellation are non-refundable.
  • If cancellation occurs mid-milestone, Grow With Gradient will invoice for the proportion of work completed at the point of cancellation, assessed on an hours-invested basis. Any overpayment against this pro-rated amount will be refunded within 14 business days.
  • Third-party costs incurred on the client's behalf (tool subscriptions, data purchases, hosting, paid placements) are non-refundable regardless of cancellation timing.

4. Free Paid-to-Organic Gap Analysis

The gap analysis is delivered at no charge as part of our sales process. Because there is no fee, no refund is applicable. If a client proceeds to an onboarding engagement directly linked to the gap analysis, the onboarding fee is subject to the fixed-scope project terms above.

5. Service Credits

Where a deliverable is not completed to the standard agreed in the SOW, Grow With Gradient's primary remedy is to revise or redo the deliverable at no additional cost within a reasonable timeframe. Monetary refunds are a secondary remedy and are offered only where:

  • A revision is not technically or practically feasible; or
  • Grow With Gradient fails to deliver a completed revision within 30 days of a documented deficiency notice.

6. How to Request a Refund

To initiate a refund or cancellation, send a written request to hello@growwithgradient.com with:

  • Your company name and engagement reference number
  • The reason for cancellation or refund request
  • The amount and invoice number(s) you believe are refundable

We will acknowledge your request within 3 business days and provide a written determination within 10 business days. Approved refunds are processed within 14 business days of the determination date. Refunds are issued via the original payment method where technically possible; wire transfer to the original remitting bank account otherwise.

7. Disputes and Governing Law

Any dispute arising from or in connection with this policy shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, the dispute shall be subject to the jurisdiction of the courts at Ranchi, Jharkhand, India, under the laws of India.
